As the U.S. works toward getting more 11,000 Americans, diplomats and Afghan allies out of the country, what kind of Taliban should the U.S. expect to deal with in Afghanistan?  So far, there have been assurances from the Taliban that a new regime may not be as brutal as regimes past, but few who have worked with the Taliban believe the assurances.  How might the regime work with, or shelter groups like al-Qaeda, which is the reason why the U.S. entered into Afghanistan after 9/11.  And how might a massive-scale exodus of Afghans impact neighboring countries?

The Cipher Brief sat down with the former National Intelligence Manager for Iran at ODNI, Norman T. Roule to get his expert-level perspective.

Norman T. Roule, Former National Intelligence Manager for Iran, ODNI

Cipher Brief Expert Norm Roule served for 34-years in the Central Intelligence Agency, managing numerous programs relating to Iran and the Middle East. He served as the National Intelligence Manager for Iran (NIM-I) at the Office of the Director of National Intelligence from November 2008 until September 2017.  As NIM-I, he was the principal Intelligence Community (IC) official responsible for overseeing all aspects of national intelligence policy and activities related to Iran, to include IC engagement on Iran issues with senior policy makers in the National Security Council and the Department of State.

The Cipher Brief: How would you characterize the international community’s response to the Taliban victory in Afghanistan?

Roule:  Historians of the future will likely describe the response to the Taliban victory as a strange mix of apathy and confusion.

In terms of apathy, there is extraordinary irony in the fact that after spending so much blood and treasure to defeat Da’esh efforts to establish an extremist Islamic Republic in Syria and impose its oppression over Iraqis and Syrians, the international community failed to prevent the creation of an Islamic Republic in Afghanistan. Many of the arguments behind our involvement in Syria – from a refugee crisis to the need to deny international Islamic militants a home to birth new terror groups – apply to Afghanistan. Whether or not one supported this decision, it is hard to avoid thinking that this episode will embolden militants worldwide.

In terms of confusion, we seem to be unable to accept that no one can predict the course and pace of crowd dynamics that so quickly eroded Afghan resistance. We live in a world where people acknowledge their inability to predict who will win our presidential elections but insist the Intelligence Community can somehow predict the day events will occur in a denied environment. But such a worst-case possibility should have been part of the planning deck and resourced on the ground accordingly.

The Cipher Brief: How would you expect the international community to respond in the coming days?

Roule: Absent a Taliban attack, operations at the airport should proceed more smoothly as our response architecture grows. Beyond that, much depends on how the Taliban act in the coming weeks. The group is not a monolith. Their success was highly likely as much a surprise to them as anyone. As they define their path and choose their leaders, there will be internal debates, jockeying for power, and perhaps some violent infighting.

In terms of indicators of the regime’s direction, we may want to consider the following questions:

First and foremost, how will the Taliban respond to our ongoing evacuation? Thus far, they seem willing to let us leave untouched, probably believing that the sooner we get out, the easier it will be for them to take control. At the same time, international media coverage of the evacuation will impose a strategic embarrassment on Washington.

Second, to what extent have the Taliban changed? They certainly understand that diplomacy played a role in their victory. Some of their leaders have spent hundreds of hours with foreign diplomats and traveled to multiple foreign capitals. How will these leaders merge such experiences into governance with more insular colleagues? They are likely to talk initially about compromise regarding women’s rights and inclusion of opponents in the government, but this may well be another effort to buy time. The international community has few pressure points over the group. How this plays out will be a good indicator of how they plan to run the country.

Next, how will they handle the issue of al-Qaida and other terrorists? We cannot overlook the deep connections between the Taliban and al-Qaida. If they believe the international community will limit its response to demarches, press statements, and empty sanctions, many in the group will be inclined to allow al-Qaida to reorganize.

Last, I would look at the refugee issue. They are likely to welcome external aid and allow at least some humanitarian groups to remain in country. Doing so requires no political concessions, addresses a domestic headache, and provides an opportunity for corruption. Humanitarian groups also offer a lever the Taliban can use against the West, i.e., refrain from criticizing us, or we will block your humanitarian operations. The Houthis have done this with great effect in Yemen.

The Cipher Brief: How do you think will China, Russia, and other adversaries will respond to the withdrawal? 

Roule: Chinese propagandists have aggressively exploited our evacuation from Afghanistan. Its media is already claiming that these events show Taiwan that “once war breaks out in the Straits, the island’s defense will collapse in hours, and the US military won’t come to respond.” China’s press has also reportedly announced that the U.S. will not stand by Hong Kong activists.

Beijing, Tehran, and their proxies will likely point to the withdrawal as evidence that the U.S. is a declining power, unwilling or incapable of defending its friends. It will be lost on no one that whereas the U.S. has abandoned Afghanistan, Russia, China, and Iran have not wavered in support of their – admittedly few and otherwise isolated – allies.

In a worse case, if our adversaries believe the withdrawal reflects a lack of national resolve, they may be tempted to test our will on other issues. In this case, a miscalculation could lead to a conventional war in another theater.

The Cipher Brief: What would you say to those who say that the withdrawal demonstrates that the U.S. will only focus on strategic interests?

Roule:  Certainly, this argument has an appeal. It is true that our strategic adversaries like nothing better than the U.S. expending resources and diplomatic energy in such areas as Afghanistan, in part because we are, in essence, protecting their interests for free. But it does beg two questions.

First, what will happen differently next year regarding China, Russia, efforts to combat climate change, and cyber actors, now that we are out of Afghanistan? Second, what exactly is a U.S. strategic interest that we would protect? Estonia? Bahrain? Taiwan?

This argument also glosses over how others respond to such a posture. If a country perceives itself outside the international community’s protection, it will likely accommodate an aggressor. Our next call for a coalition of the willing will likely meet with less enthusiasm.

U.S. influence depends on the respect shown to us in multiple arenas. The echoes of this localized respect become self-reinforcing. We should think about what happens to collective international security if these echoes are silenced.

Last, this argument inherently argues that values are strategic interests. Unless violence directly touches Americans, we will limit our response to diplomacy and public statements. Such protests are unlikely to stop those behind a future Srebrenica massacre or the Rwandan genocide. Indeed, one can make a case that such a response might even encourage such events.

The Cipher Brief: How can the U.S. now best demonstrate its national resolve?

Roule:  As the saying goes, the best way to demonstrate national resolve is to demonstrate national resolve. Fair or not, this episode will tar the Biden administration. It doesn’t help that some allies reportedly have complained that the U.S. did not sufficiently consult with them on its decision to withdraw. Public criticism of the withdrawal decision by some of our closest European partners is growing. Adversaries will now consider their action through the lens of Afghanistan, much as the post-Vietnam malaise encouraged Soviet aggression in the 1970s.

I am not saying that we can’t reverse this situation. The U.S. withdrawal from Lebanon in 1984 caused many to question U.S. resolve. Although it did signal an end to U.S. (and international) efforts to eradicate Hezbollah, Reagan’s actions in other arenas (to include Afghanistan) restored the image of U.S. national resolve. Difficult diplomacy and a demonstration of our willingness to use military power when needed lay ahead.

The Cipher Brief: What does the return of the Taliban mean for al-Qaeda?

Roule:  There is little reason to believe the Taliban-Al-Qaida relationship will not resume, although al-Qaeda is a fragmented and a pale version of its original stature. Nonetheless, it is easy to imagine the delight of its remaining leadership and cadres. Elements in Iran will likely seek to return to Afghanistan, perhaps assuring Iran that in exchange for tolerance of periodic transit of Iranian territory, the group will use its influence with the Taliban to protect Iran’s interests. We should watch for any signs of a return to Afghanistan by Zawahiri’s deputy, Sayf al-Adel, who is currently in Iran with other members of the group’s leadership council.

But al-Qaeda is not the only actor on this stage. Its leader Ayman al-Zawahiri has not appeared for months and has far less influence than Osama Bin Laden. Afghanistan also hosts al-Qaeda in the Indian Subcontinent (AQIS), ISIS, and other groups. The Taliban have emptied Afghanistan’s prisons which held deeply committed and dangerous militants who may gravitate to whatever new militant leadership might arise. But a lethal threat to Americans is sure to appear. The only questions are its size, goals, and reach.

The Cipher Brief: What does the U.S. withdrawal mean for China and Russia?

Roule: Both countries have sought to undercut U.S. influence in Afghanistan. They will each be delighted with the rhetorical violence of our internal debate over the withdrawal. But they also enjoyed the stability our engagement provided in a country so close to their borders.

Both countries have developed relations with the Taliban. I believe each hosted a Taliban delegation in recent weeks. It shouldn’t be lost on us that neither country felt compelled to withdraw its personnel from Kabul. That’s a pretty good sign of their confidence in the relationship.

Outside of Afghanistan, each will use the withdrawal to increase their influence with Central Asian actors – including Turkey. Coordination on terrorism and narcotics issues will come most easily. For example, Uzbekistan will worry that the Taliban will renew support of the violent Islamic Movement of Uzbekistan, which has long maintained a presence in Afghanistan.

China’s concerns will be threefold. Beijing will use economic and diplomatic inducements to ensure that the Taliban do not encourage unrest among China’s oppressed Uighur population, let alone support the East Turkistan Islamic Movement or other Chinese militants in Xinjiang province. Next, Beijing will want to explore the Belt and Road access Afghanistan offers. Last, China will likely test whether it can achieve a commercially viable deal to mine Lithium and other minerals. In that mine operations require many years to develop and a vast amount of capital to construct, such arrangements are likely to be few given Afghanistan’s unpredictable political and security environment.

As for Russia, the U.S. withdrawal offers a chance for greater influence in Central Asia. We should watch for signs of new Russian military bases in the region. Moscow’s concern that Afghanistan will once more become a sanctuary for anti-Russian terrorists will also drive its relationship with the Taliban.

The Cipher Brief: What about Iran and Pakistan?

Roule: Iran has long maintained a relationship with Taliban elements. Reportedly, this involved sanctuary and provision of some weaponry. Tehran’s goals were to hedge its bets in Afghanistan, influence the enemies of the U.S., and protect the Shi’a of Afghanistan.

On the last point, Iran may have much work to do. Taliban personnel reportedly tore down Shi’a posters as they entered Kabul. Tehran must now contend with the consequences of refugees and the rise of warlords on its border.

The current head of Iran’s Qods Force, Esmail Qaani, has considerable experience on Afghan issues, and I expect he will play a prominent role in Iran’s response. We should watch to see how the Qods Force deploys its seasoned Afghan Fatemiyoun proxies from Syria.

Pakistan’s long-time relationship with the Taliban will give it more influence over the group than other countries. But Islamabad also will be on the receiving end of a flood of refugees, renewed militant terrorism in its loosely-controlled border areas, and Western pressure for its support of the Taliban. Ties to the Taliban may also complicate Islamabad’s relationship with India and China.

The Cipher Brief: What does this mean for the U.S. intelligence community?

Roule: The counterterrorism cadre of the US intelligence community and its partners have achieved extraordinary successes in the last years. But their work is now more complicated but no less urgent. For example, our withdrawal has reduced collection streams and potential access when the Afghanistan-based terrorist threat has only begun to grow. This challenge arrives as we shift counterterrorism resources from al-Qaeda to domestic extremists, cyber threats, and China.

The Cipher Brief: Any final comments?

Roule: If I may, I would like to close with a couple of brief comments.

First, we need to do everything we can to support personnel on the ground in Afghanistan. They – and their support teams at home – are trying to restore order in the middle of a hurricane. We are watching heroism at its best.

Next, the narrative of Afghanistan is unsurprisingly partisan. But politics shouldn’t obscure the truth. For more than twenty years, thousands of American and coalition partners volunteered to risk their lives in Afghanistan. We didn’t come to colonize. We didn’t steal Afghan resources. The operational goals were to bring Bin Laden to justice, destroy al-Qaeda, and prevent Afghanistan from becoming a haven for the group in the future. We also worked to transform Afghan society. The need for this last effort wasn’t apparent at the outset of our invasion. But it was likely unavoidable if we hoped to satisfy our values and enable Afghan society to confront its militant population. This effort represents the best of our values, and we owe all who served in this arena our most profound respect. Afghans who have participated in their country’s efforts during the past two decades will endure tremendous suffering. But they remain Afghanistan’s best hope and they deserve our support. Last, we need to end the fiction that Afghans didn’t fight for their country. Tens of thousands of Afghans were killed and wounded in the fight against al-Qaeda. Many involved in this fight are reportedly being sought door-to-door by the Taliban. Discounting their efforts may serve a political narrative, but it does them a terrible injustice.

Israeli and UAE defense suppliers have agreed to jointly develop unmanned vessels that can be tailored for a range of military roles, including anti-sub warfare. The move comes after the two countries held naval drills last week.

Emirati state-owned weapons maker EDGE group and the government-run Israel Aerospace Industries (IAI) announced the partnership in Dubai on Thursday. In a joint statement, the firms said they would design the 170 m-USV (modular-unmanned surface vessels) series for both military and commercial applications.

The vessels, which can apparently operate remotely or with partial and complete autonomy, are expected to be used for “maritime security operations,” intelligence-gathering, surveillance, detecting and countering submarines and mines, and as a deployment platform for vertical take-off and landing (VTOL) aircraft such as helicopters and certain types of drones.

Israel holds first navy drills with ‘frenemies’ from Persian Gulf

For commercial use, the manufacturers noted that they can be customized to serve in a variety of roles, including oceanography, pollution monitoring, oil and gas exploration, transportation, search and rescue, firefighting, and first interventions.

While not specifying the sources and amount of the project’s funding, or when production would begin, EDGE Chief Executive Faisal Al Bannai described the deal as an “important milestone” that would “open many doors” for the company in “local and global markets, military and commercial alike.”

According to the statement, the EDGE-owned Abu Dhabi Ship Building (ADSB) will design the vessel and integrate the platform’s control systems and payload. IAI will develop the autonomous control systems and provide various mission-requirement payloads to the control system units.

In March, the two companies had partnered up to develop an autonomous drone defense system to “detect, identify and intercept a broad range of threats.”

Last week, the UAE and Bahrain conducted their first-ever joint maritime drill with Israel’s navy. The US Fifth Fleet also participated in the five-day show of force in the Red Sea, which was reported by Israeli media outlets as sending a message to Iran.

The naval exercises came a little more than a year after Israel and the UAE established diplomatic ties in normalization agreements brokered by the Trump administration. The Abraham Accords broke decades of Arab consensus to not formally recognize Israel until the issue of a Palestinian state was settled.

Clinics in the Austrian region of Salzburg have set up a special assessment team tasked with identifying Covid patients who have a higher chance of survival; the rest may soon have to take a back seat.

Amid a dramatic spike in Covid cases, medical personnel warn they may soon have to make the heart-wrenching choice of which patients get life-saving treatment and which ones will have to wait, Austrian media report. Intensive care units in the Salzburg region are packed, with the number of patients treated there setting a new grim record on Tuesday, reaching 33. The region ranks amid Austria’s hardest-hit, logging more than 1,500 new infections per 100,000 residents in a week. In an emotional plea for help to the local government, the head of Salzburg’s hospitals warned that soon clinics would likely not be able to guarantee the existing level of standards in terms of medical treatment. A representative for the city clinics likened the situation to “running into a wall.

The region’s governor, Wilfried Haslauer, announced on Tuesday that some of the Covid patients whose condition was no longer life-threatening would be transferred from hospitals to rehabilitation centers to make room for more serious cases.

Austria imposes compulsory vaccination from February 1 & nationwide lockdown starting Monday

In neighboring Upper Austria, the situation is no better, with the number of deaths in intensive care units surpassing figures seen in all the previous Covid waves. Speaking to Austria’s Der Standard paper on condition of anonymity, healthcare workers there said they had free beds “because the infected are dying.

For the time being, the creation of a so-called ‘triage team’ in Salzburg hospitals is being described as a “precautionary measure.” The panel is made up of six people: one legal expert and five providers from various medical disciplines. If push comes to shove, they will be deciding which patients stand a chance and which treatments have little prospect of success.

The longest lunar eclipse in over 500 years will occur in the early hours of November 19, lasting several hours.

The peak of the partial eclipse will take place in the predawn hours on Friday when 97% of the moon will be eclipsed by the Earth’s shadow. The previous longest partial eclipse took place in 2018 and lasted less than two hours, while this will last for several hours.

The eclipse will be visible from all 50 US states, Canada, and Mexico, as well as parts of South America, Polynesia, Australia, and China, according to NASA.

The moon will be at its farthest point from Earth during the eclipse, slowing its orbit and extending the time it takes to move out of the darkest part of the planet’s shadow, known as the umbra, as the moon, Earth, and sun will all be aligned. The Holcomb Observatory has released a video detailing what the eclipse will look like. 

The event will begin shortly after midnight and unlike a solar eclipse, no one will need special eyewear to view the phenomenon.

When the eclipse occurs, the moon will take on a reddish hue, with only a sliver of the actual moon visible. The event will last for several hours, making it the longest of its kind in 580 years, with the next lunar eclipse not occurring until May of 2022.

Sporadic clashes broke out at massive Saturday demonstrations in major European cities, as thousands of people took to the streets of Vienna, Paris and Rome to express their discontent with Covid-19 restrictions.

The Austrian capital Vienna on Saturday saw the largest protest turnout since the start of the Covid-19 pandemic. A total of 38,000 people took to the city streets to join a dozen demonstrations protesting government measures.

The protests came a day after the Austrian authorities ordered nationwide compulsory vaccination from February 1 and imposed a full lockdown, starting Monday. The massive procession that spanned over several kilometers marched along Vienna’s central ring road. The city center was paralyzed for several hours as traffic was restricted.

Austria’s right-wing Freedom Party, whose members joined the rallies, put the number of protesters at 100,000. Some demonstrations were also attended by members of various far-right groups. The protests were generally peaceful but footage published by Ruptly video news agency showed several scuffles between the police and the demonstrators breaking out.

Law enforcement spoke of a total of five arrests. One incident saw a protester attempting to grab an officer’s gun and take it from its holster. In another incident, the officers were pelted with bottles and fireworks and had to use pepper spray in response.

Hundreds of kilometers away from Vienna, in the French capital Paris, events took a more dramatic turn. There, a demonstration against the government Covid-19 measures coincided with the third anniversary of the Yellow Vests movement. Hundreds of protesters took part in the protest, which quickly turned into clashes between the demonstrators and law enforcement.

The protesters were building barricades and setting them on fire as well as pelting police with bottles and various other projectiles. Law enforcement responded with profuse amounts of tear gas, sometimes filling entire streets with thick smoke to disperse the crowds.

Rome saw a massive demonstration against Italy’s Covid-19 health pass, also known as the Green Pass. Some 4,000 people gathered in the center of the Italian capital, according to the police. The demonstrators were waving national flags and chanting “Freedom” and “No Green Pass,” referring to the vaccination certificate needed to enter various public venues such as clubs or bars.

The crowd staged a sit-in in the Circus Maximus – an ancient Roman chariot-racing stadium converted into a modern-day park. They remained there after sunset, lighting the area with thousands of phones and colored smoke bombs. The rally was peaceful, though, as the police did not report any incidents.

Unlike Rome, Italy’s northern city of Milano saw clashes between protesters and the police as law enforcement officers sought to break up an unauthorized rally at the city center. Large police forces were deployed to the city center and several squares were cordoned off.

An adviser to the EU’s top court has claimed that citizens’ information in Germany is being illegally harvested, after telecom companies challenged bulk data collection.

The German data retention law was criticized on Thursday by an adviser to the Court of Justice of the European Union (CJEU), who stated that general and indiscriminate retention of traffic and location data is only allowed in exceptional cases, such as a threat to national security.

According to the adviser, bulk collection of data generates a ‘serious risk’ of leaks or improper access. It also entails a ‘serious interference’ with citizens’ fundamental rights to privacy and the protection of personal data.

Google won’t pay for spying on UK iPhone users

This comes after two companies, SpaceNet and Telekom Deutschland, challenged the obligation to store their customers’ telecommunications traffic data in 2016. The Administrative Court of Cologne ruled that the two companies were not obliged to retain data because such an obligation violated Union law. Germany then appealed to the Federal Administrative Court, who asked the CJEU about the compatibility of the data retention obligation.

The CJEU has often stated that indiscriminate mass surveillance does not fit within the general principles of EU law. Over a year ago it saw a similar case involving legal challenges around national bulk data collection under UK and French law. The court then ruled that only limited data collection and temporary retention were allowed. France seeks to bypass the CJEU on data retention and has asked the country’s highest administrative court (the Council of State) not to follow the EU ruling. France is waiting for the conclusion of the procedure launched by the Council of State before “assessing to what extent” national law should be changed. 

Despite recent EU court attempts to curb surveillance powers, leaked papers from June 2021 show that the national governments of the Netherlands, France, Spain, Luxembourg, Slovakia, and Estonia are pushing for a new pan-EU data retention law. A Roadmap for AI in the Intelligence Community

(Editor’s Note: This article was first published by our friends at Just Security and is the fourth in a series that is diving into the foundational barriers to the broad integration of AI in the IC – culture, budget, acquisition, risk, and oversight.  This article considers a new IC approach to risk management.)

OPINION — I have written previously that the Intelligence Community (IC) must rapidly advance its artificial intelligence (AI) capabilities to keep pace with our nation’s adversaries and continue to provide policymakers with accurate, timely, and exquisite insights. The good news is that there is strong bipartisan support for doing so. The not-so-good news is that the IC is not well-postured to move quickly and take the risks required to continue to outpace China and other strategic competitors over the next decade.

In addition to the practical budget and acquisition hurdles facing the IC, there is a strong cultural resistance to taking risks when not absolutely necessary. This is understandable given the life-and-death nature of intelligence work and the U.S. government’s imperative to wisely execute national security funds and activities. However, some risks related to innovative and cutting-edge technologies like AI are in fact necessary, and the risk of inaction – the costs of not pursuing AI capabilities – is greater than the risk of action.

The Need for a Risk Framework

For each incredible new invention, there are hundreds of brilliant ideas that have failed. To entrepreneurs and innovators, “failure” is not a bad word. Rather, failed ideas are often critical steps in the learning process that ultimately lead to a successful product; without those prior failed attempts, that final product might never be created. As former President of India A.P.J. Abdul Kalam once said, “FAIL” should really stand for “First Attempt In Learning.”

The U.S. government, however, is not Silicon Valley; it does not consider failure a useful part of any process, especially when it comes to national security activities and taxpayer dollars. Indeed, no one in the U.S. government wants to incur additional costs or delay or lose taxpayer dollars. But there is rarely a distinction made within the government between big failures, which may have a lasting, devastating, and even life-threatening impact, and small failures, which may be mere stumbling blocks with acceptable levels of impact that result in helpful course corrections.

As a subcommittee report of the House Permanent Select Committee on Intelligence (HPSCI) notes “[p]rogram failures are often met with harsh penalties and very public rebukes from Congress which often fails to appreciate that not all failures are the same. Especially with cutting-edge research in technologies … early failures are a near certainty …. In fact, failing fast and adapting quickly is a critical part of innovation.” There is a vital difference between an innovative project that fails and a failure to innovate. The former teaches us something we did not know before, while the latter is a national security risk.

Faced with congressional hearings, inspector general reports, performance evaluation downgrades, negative reputational effects, and even personal liability, IC officers are understandably risk-averse and prefer not to introduce any new risk. That is, of course, neither realistic nor the standard the IC meets today. The IC is constantly managing a multitude of operational risks – that its officers, sources, or methods will be exposed, that it will miss (or misinterpret) indications of an attack, or that it will otherwise fail to produce the intelligence policymakers need at the right time and place. Yet in the face of such serious risks, the IC proactively and aggressively pursues its mission. It recognizes that it must find effective ways to understand, mitigate, and make decisions around risk, and therefore it takes action to make sure potential ramifications are clear, appropriate, and accepted before any failure occurs. In short, the IC has long known that its operations cannot be paralyzed by a zero-risk tolerance that is neither desirable nor attainable. This recognition must also be applied to the ways in which the IC acquires, develops, and uses new technology.

This is particularly important in the context of AI. While AI has made amazing progress in recent years, the underlying technology, the algorithms and their application, are still evolving and the resulting capabilities, by design, will continue to learn and adapt. AI holds enormous promise to transform a variety of IC missions and tasks, but how and when these changes may occur is difficult to forecast and AI’s constant innovation will introduce uncertainty and mistakes. There will be unexpected breakthroughs, as well as failures in areas that initially seemed promising.

The IC must rethink its willingness to take risks in a field where change and failure is embraced as part of the key to future success. The IC must experiment and iterate its progress over time and shift from a culture that punishes even reasonable risk to one that embraces, mitigates, and owns it. This can only be done with a systematic, repeatable, and consistent approach to making risk-conscious decisions.

Today there is no cross-IC mechanism for thinking about risk, let alone for taking it. When considering new activities or approaches, each IC element manages risk through its own lens and mechanisms, if at all. Several individual IC elements have created internal risk assessment frameworks to help officers understand the risks of both action and inaction, and to navigate the decisions they are empowered to make depending upon the circumstances. These frameworks increase confidence that if an activity goes wrong, supervisors all the way up the chain will provide backing as long as the risk was reasonable, well-considered and understood, and the right leaders approved it. And while risk assessments are often not precise instruments of measurement – they reflect the quality of the data, the varied expertise of those conducting the assessments, and the subjective interpretation of the results – regularized and systematic risk assessments are nevertheless a key part of effective risk management and facilitate decision-making at all levels.

Creating these individual frameworks is commendable and leading-edge for government agencies, but more must be done holistically across the IC. Irregular and inconsistent risk assessments among IC elements will not provide the comfort and certainty needed to drive an IC-wide cultural shift to taking risk. At the same time, the unique nature of the IC, comprised of 18 different elements, each with similar and overlapping, but not identical, missions, roles, authorities, threats and vulnerabilities, does not lend itself to a one-size-fits-all approach.

For this reason, the IC needs a flexible but common strategic framework for considering risk that can apply across the community, with each element having the ability to tailor that framework to its own mission space. Such an approach is not unlike how the community is managed in many areas today – with overarching IC-wide policy that is locally interpreted and implemented to fit the specific needs of each IC element. When it comes to risk, creating an umbrella IC-wide framework will significantly improve the workforce’s ability to understand acceptable risks and tradeoffs, produce comprehensible and comparable risk determinations across the IC, and provide policymakers the ability to anticipate and mitigate failure and unintended escalation.

Critical Elements of a Risk Framework

A common IC AI risk framework should inform and help prioritize decisions from acquisition or development, to deployment, to performance in a consistent way across the IC. To start, the IC should create common AI risk management principles, like its existing principles of transparency and AI ethics, that include clear and consistent definitions, thresholds, and standards. These principles should drive a repeatable risk assessment process that each IC element can tailor to its individual needs, and should promote policy, governance, and technological approaches that are aligned to risk management.

The successful implementation of this risk framework requires a multi-disciplinary approach involving leaders from across the organization, experts from all relevant functional areas, and managers who can ensure vigilance in implementation. A whole-of-activity methodology that includes technologists, collectors, analysts, innovators, security officers, acquisition officers, lawyers and more, is critical to ensuring a full 360-degree understanding of the opportunities, issues, risks, and potential consequences associated with a particular action, and to enabling the best-informed decision.

Given the many players involved, each IC element must strengthen internal processes to manage the potential disconnects that can lead to unintended risks and to create a culture that instills in every officer a responsibility to proactively consider risk at each stage of the activity. Internal governance should include an interdisciplinary Risk Management Council (RMC) made up of senior leaders from across the organization. The RMC should establish clear and consistent thresholds for when a risk assessment is required, recommended, or not needed given that resource constraints likely will not allow all of the broad and diverse AI activities within organizations to be assessed. These thresholds should be consistent with the IC risk management principles so that as IC elements work together on projects across the community, officers have similar understandings and expectations.

The risk framework itself should provide a common taxonomy and process to:

  • Understand and identify potential failures, including the source, timeline, and range of effects.
  • Analyze failures and risks by identifying internal vulnerabilities or predisposing conditions that could increase the likelihood of adverse impact.
  • Evaluate the likelihood of failure, taking into consideration risks and vulnerabilities.
  • Assess the severity of the potential impact, to include potential harm to organizational operations, assets, individuals, other organizations, or the nation.
  • Consider whether the ultimate risk may be sufficiently mitigated or whether it should be transferred, avoided, or accepted.

AI-related risks may include, among other things, technology failure, biased data, adversarial attacks, supply chain compromises, human error, cost overruns, legal compliance challenges, or oversight issues.

An initial risk level is determined by considering the likelihood of a failure against the severity of the potential impact. For example, is there is a low, moderate, or high likelihood of supply chain compromise? Would such a compromise affect only one discrete system or are there system-wide implications? These calculations will result in an initial risk level. Then potential mitigation measures, such as additional policies, training, or security measures, are applied to lower the initial risk level to an adjusted risk level. For example, physically or logically segmenting an organization’s systems so that a compromise only touches one system would significantly decrease the risk level associated with that particular technology. The higher the likelihood of supply chain compromise, the lower the severity of its impact must be to offset the risk, and vice versa. Organizations should apply the Swiss Cheese Model of more than one preventative or mitigative action for a more effective layered defense. Organizations then must consider the adjusted risk level in relation to their tolerance for risk; how much risk (and potential consequence) is acceptable in pursuit of value? This requires defining the IC’s risk tolerance levels, within which IC elements may again define their own levels based upon their unique missions.

Understanding and considering the risk of action is an important step forward for the IC, but it is not the last step. Sometimes overlooked in risk assessment practices is the consideration of the risk of inaction. To fully evaluate potential options, decision-makers must consider whether the overall risk of doing something is outweighed by the risks of not doing it. If the IC does not pursue particular AI capabilities, what is the opportunity cost of that inaction? Any final determination about whether to take action must consider whether declining to act would cause greater risk of significant harm. While the answer will not always be yes, in the case of AI and emerging technology, it is a very realistic possibility.

And, finally, a risk framework only works if people know about it. Broad communication – about the existence of the framework, how to apply it, and expectations for doing so – is vital. We cannot hold people accountable for appropriately managing risk if we do not clearly and consistently communicate and help people use the structure and mechanisms for doing so.

Buy-in To Enhance Confidence

An IC-wide AI risk framework will help IC officers understand risks and determine when and how to take advantage of innovative emerging technologies like AI, increasing comfort with uncertainty and risk-taking in the pursuit of new capabilities. Such a risk framework will have even greater impact if it is accepted – explicitly or implicitly – by the IC’s congressional overseers. The final article in this series will delve more deeply into needed changes to further improve the crucial relationship between the IC and its congressional overseers. It will also provide a link to a full report that provides more detail on each aspect of the series, including a draft IC AI Risk Framework.

Although Congress is not formally bound by such a framework, given the significant accountability measures that often flow from these overseers, a meeting of the minds between the IC and its congressional overseers is critical. Indeed, these overseers should have awareness of and an informal ability to provide feedback into the framework as it is being developed. This level of transparency and partnership would lead to at least two important benefits: first, increased confidence in the framework by all; and second, better insight into IC decision-making for IC overseers.

Ultimately, such a mutual understanding would encourage exactly what the IC needs to truly take advantage of next-generation technology like AI: a culture of experimentation, innovation, and creativity that sees reasonable risk and failure as necessary steps to game-changing outcomes.

Australia’s Jewish community has condemned the repeated displays of Nazi references at anti-vaccine and anti-lockdown rallies in Victoria, some of which saw the state premier depicted as Adolf Hitler.

Daniel Aghion, the president of the Jewish Community Council of Victoria, claims that references to the genocidal regime of the Nazis amid the current unrest over pandemic rules is a false equivalence.

“The Nazis had the intention of wiping from the face of the Earth a race or religion simply because of what they were,” Aghion told Guardian Australia. “Nothing in the current proposals is remotely like that, and the comparison to Nazi Germany is therefore shocking, inappropriate and wrong,” he added.

Aghion’s comments come after demonstrators, protesting against pandemic laws, referenced Nazi Germany in an effort to make their point. Some carried placards depicting state premier, Daniel Andrews, as Hitler. 

 Wendy Lovell, a Liberal MP, had also claimed laws proposed to govern future pandemics were similar to Germany’s 1933 Enabling Act – which allowed the Reich government to issue laws without the consent of parliament and preceded atrocities, most notably the Holocaust.

MP Bernie Finn had gone as far as to share a social media post depicting the state premier as Hitler. It was later deleted.Laws proposed by Andrews seek to grant powers to the state leaders in the event of another pandemic. Under the move, the minister “may make any order… that the minister believes is reasonably necessary to protect public health.” 

Opponents claim the legislation, which would see power concentrated with the head of state and health minister, is too broad and far reaching.
